New England Patriots' Tom Brady To Appeal 4-Game Deflategate Suspension

After having his four-game suspension reinstated by a court last month, New England Patriots quarterback Tom Brady has reportedly decided to appeal the decision. Monday was the last day for Brady to file that appeal, and he and his new lawyer have decided to move forward with it.

“The facts here are so drastic and so apparent that the court should rehear it,” NFL Players Association attorney Theodore B. Olson told ‘Good Morning America’ on Monday.

“If the court chooses not to rehear the case, Brady could then petition the U.S. Supreme Court and ask for a stay of the second circuit decision. If the second circuit doesn’t grant a stay, Brady’s lawyers can ask for a stay of the decision from the Supreme Court, which would be decided by Justice Ruth Bader Ginsberg. If Ginsberg granted a stay or the court decided to hear the case, Brady almost certainly would be eligible to play the entire 2016 season due the Supreme Court’s schedule.”

Brady was originally suspended four games by the NFL in May 2015 after attorney Ted Wells concluded that it was “more probable than not” that the Patriots quarterback was “generally aware” that two team employees deflated footballs prior to the 2015 AFC Championship Game against the Indianapolis Colts.
